1. Scope of the General Terms and Conditions
These General Terms and Conditions (hereinafter referred to as the GTC) apply exclusively to legal transactions between Familie Wiesner Gastronomie AG, Zürichstrasse 131, 8600 Dübendorf (hereinafter ‘FWG’) and the customer in connection with the processing of orders, the loyalty programme and, where offered, the booking of sushi cooking courses via negishi.ch or nooch.ch or via the ordering website of the relevant FWG restaurant (hereinafter ‘Online Services’). FWG provides these services exclusively on the basis of these Terms and Conditions.
By completing an order or registering on the Rewardz app or website, the customer confirms that they have read, understood and accepted these Terms and Conditions without reservation.
FWG reserves the right to amend these Terms and Conditions at any time. The version published at the time of placing an order or using the loyalty programme shall be deemed authoritative.
 
2. Availability
Although FWG endeavours, in accordance with the state of the art, to offer the highest possible level of availability for its online services, it is not possible to guarantee this availability at specific times. FWG shall not be liable for the availability of the online services at all times.
FWG reserves the right to modify, interrupt or discontinue the online services offered, either temporarily or permanently, with or without notice to the customer. FWG shall not be liable to the customer for any modification, interruption or discontinuation of the online services.
 
3. Links
The FWG restaurants’ websites may contain links to other external websites or external sources. FWG has no control over the availability or content of these websites or sources and therefore accepts no liability for any consequences arising from a visit to the respective sites.
 
4. Ordering
Customers can use the online services to order food and drink for collection from the relevant FWG restaurant or for delivery. The contract is deemed to have been validly concluded from the moment the customer finalises the order on the relevant order page.
The prices listed on the online service at the time of ordering apply. Prices are quoted in Swiss francs, inclusive of VAT but excluding delivery charges. Depending on the offer, payments can be made by credit card, TWINT or another payment method specified on the online service. The amount will be debited at the time of ordering.
Deliveries will only be made once a minimum order value, which depends on the delivery distance, has been reached. The minimum order value and the delivery charge are determined by the distance between the restaurant’s location and the delivery address provided by the customer. The relevant amounts are displayed to the customer on the online service.
Delivery may be carried out, at FWG’s discretion, either by its own couriers or by delivery partners commissioned by it (e.g. Uber Eats, Just Eat).
Cancellations of orders by the customer are only permitted if they are made immediately by telephone to the relevant branch and, in the case of deliveries, if FWG is able to contact the courier or delivery partner in good time before the delivery begins. If FWG is unable to contact the courier or delivery partner in good time, the delivery charge for the order will be invoiced.
The contract can only be fulfilled if the customer has previously provided truthful, up-to-date and complete personal details on the order form. The customer must report any errors in the information provided to FWG immediately after placing the order. Personal details include information on how the customer can be contacted during the delivery of the order.
The customer is obliged to be present at the time of delivery if they have selected the “Doorstep delivery” option. If this is not the case and the courier or delivery partner is unable to contact the customer using the details provided, the courier or delivery partner is entitled – where possible – to leave the delivery in the relevant letterbox or to take it back with them. The same applies if the customer fails to pay for the delivery. FWG shall not be liable for any loss or damage that may result from this. In the event of incorrect details provided in connection with orders (e.g. incorrect or incomplete delivery information, or the customer’s absence at the time of delivery), the delivery charge for the order will be charged.
A delayed delivery does not entitle the customer to cancel the order or demand a refund of the order price.
The resale of FWG products is prohibited.
The law prohibits the sale of and the free distribution of:
- wine, beer and cider to young people under the age of 16
- spirits, alcopops and tobacco products to young people under the age of 18
Any breach of the law will be punishable by a fine.
By completing the order, the customer confirms that they are at least 16 or 18 years old and are therefore entitled to purchase alcoholic drinks. Upon delivery or collection of the order, the restaurant, courier or delivery partner may ask for proof of identity if the order contains alcoholic products or other products subject to an age restriction. If the customer is unable to provide adequate proof of identity or does not meet the minimum age requirements, the restaurant, courier or delivery partner may refuse to deliver the relevant products to the customer and charge them a cancellation fee (including the order amount).
FWG is also entitled to exclude from the online ordering service in future any persons who fail to comply with the obligations set out here during the ordering process.
 
5. Vouchers
Vouchers can be ordered via the online service. Once the order has been successfully placed, the voucher will be sent to the customer either by post or, if this option has been selected, in electronic form by email for printing. Vouchers are valid for two years from the date of issue and can be redeemed for FWG services within this period.
Cancellations of voucher purchases made on the relevant website must be made by 3.00 pm at the latest on the relevant working day (or, for purchases made after 3.00 pm, by 3.00 pm on the following working day) by calling 044 510 50 00; otherwise, the order shall be deemed to have been fulfilled in accordance with the contract. There is no entitlement to a cash refund or a refund of the remaining balance on vouchers that have already been dispatched, and there is no right of return.
 
6. Sushi cooking courses
Registration for sushi cooking courses is binding. If you cancel your place less than 7 days before the course starts, 50% of the course fees will be charged, provided the place cannot be filled by another participant. In the event of an unexcused absence or cancellation on the day of the course or after the venue has closed the previous day, 100% of the course fees must be paid. The course organisers are entitled to cancel a course if there are insufficient participants or for other valid reasons. In this case, the customer is entitled to a refund of the course fee.
 
7. Rewardz Loyalty Programme
The Rewardz Loyalty Programme is FWG’s personalised loyalty scheme. Participation requires registration and the creation of an account on the Rewardz app or website.
The Rewardz Loyalty Programme is restricted to private households and may not be used for commercial purchases. Only one Rewardz Loyalty Programme account may be opened per person. Participation is personal, is in the name of the individual and cannot be transferred.
Participants can earn points on certain orders and restaurant visits or through other activities. The applicable conditions for the awarding of points (including the number of points awarded) are set out exclusively in the Rewardz app and are subject to change at any time. The crediting of points may also be suspended, in particular in cases of force majeure and in the event of technical problems. Points that are not redeemed within one year of being awarded will lapse without replacement. Participants may not hold more than 15,000 points at any one time. Any excess points will lapse immediately and without replacement. Participants acknowledge the points shown on their account.
Points can be redeemed for certain benefits (e.g. discounts). The applicable terms and conditions for redeeming points and for any discounts or other benefits granted (e.g. minimum order value, limited validity, etc.) are set out exclusively in the Rewardz app at the time of redemption and ordering, and are subject to change at any time. Discounts and other benefits granted but not used may not exceed the equivalent of CHF 1,000. The discounts and other benefits granted constitute an invitation to participants to make a purchase whilst benefiting from the respective discounts or other benefits. The invitation to make an offer is non-binding, expires in accordance with the terms and conditions of the Rewardz app (but no later than one year after the discount or benefit was issued) and may be revoked at any time. Discounts and other benefits cannot be combined with other promotions. Only one discount or benefit may be redeemed per purchase; any remaining value on vouchers will not be carried over.
Points, discounts and other benefits accumulated through the loyalty programme will under no circumstances be exchanged for cash.
Participants whose account has not been used for a year may be excluded from the loyalty programme. FWG also reserves the right to exclude participants from the programme in the event of breaches of the Terms and Conditions – such as commercial use or other misuse – or even without giving reasons. Any remaining points, unused discounts and benefits will lapse, and neither a transfer to another account nor a cash payout is permitted. This also applies in the event of the account holder’s death.
Participation in the loyalty programme and the allocation of all points, discounts and other benefits under the loyalty programme are at the sole discretion of FWG. FWG reserves the right to make changes to the loyalty programme or to terminate the programme at any time.
 
8. Redeeming discounts and voucher codes
Discount offers allow you to purchase products at lower prices. Voucher codes and other discount offers have a limited validity period, a minimum order value and other conditions, which are specified in the relevant voucher code. Details can be found in the description and terms and conditions of each individual voucher code. Voucher codes cannot be combined with other offers. Only one voucher may be redeemed per purchase. In the event of misuse of discount offers or voucher codes – for example, through the misuse of email addresses to impersonate other individuals – FWG reserves the right to take legal action. In particular, individuals may be excluded from ordering services in future.
 
9. Terms of payment
The customer’s invoice is due for payment within 30 days of the invoice date. In the event of non-payment, the customer shall automatically be in default and interest on arrears in accordance with Article 104 of the Swiss Code of Obligations (OR) shall be charged from that date. The following fees shall be invoiced additionally for debt collection services:
Reminders: + CHF 20.00
Debt enforcement: + CHF 100.00 (flat-rate fee for internal costs) + all external debt enforcement costs
FWG reserves the right to transfer the contractual relationship or individual rights and obligations to third parties (e.g. debt collection agencies) and to make the necessary data available in doing so.
Should the customer invoice be sent to a company and a tip have been included on this form, the guest confirms that they are authorised, in accordance with their company’s internal policy, to include tips at the company’s expense. Should the company not accept the tips, the guest confirms that they will transfer these privately within 30 days to the account specified on the customer invoice.
The same debt collection terms apply to tips as to the customer invoice itself.
 
10. Data Protection
The processing of the customer’s personal data is governed by the privacy policy available online.
 
11. Warranty and Liability
FWG shall not be liable for the performance of the contract in the event of force majeure, such as, in particular, the failure of telephone or internet lines, official measures, power cuts, etc. FWG shall also not be liable in the event of unforeseeable disruption to transport services or other unforeseeable events. This also applies if the aforementioned events occur in relation to a vicarious agent (e.g. a delivery partner) of FWG. In such cases, FWG shall endeavour to contact the customer and to remedy the relevant obstacles, where possible. If FWG is unable to deliver on time for any of the aforementioned reasons, both parties shall be released from their performance obligations.
FWG employs recognised technical and organisational security measures to protect customers’ data. Nevertheless, complete security cannot be guaranteed when transmitting information over the internet. FWG shall only be liable for damage caused by unauthorised access by third parties if it has acted with intent or gross negligence.
FWG restaurants use ingredients and additives in food and drink which may, in some circumstances, trigger allergies or intolerances. It is the customer’s responsibility to inform themselves about the relevant ingredients and, in case of doubt, to contact the relevant restaurant.
Complaints must be reported to FWG immediately upon receipt of the order, but no later than 6.00 pm on the following day; otherwise, the order shall be deemed to have been fulfilled in accordance with the contract. In the event of a valid complaint and proof of a defect, FWG may, at its discretion, either reduce the cost of the food and drink purchased or issue the customer with a free voucher (of an appropriate value). Other warranty claims are excluded. Liability is accepted for direct damage, provided there is fault on the part of FWG. Liability for indirect damage (so-called consequential damage) shall only apply in the event of wilful misconduct or gross negligence.
 
12. Intellectual Property Rights
All rights to the content of the online services (in particular texts, images, logos, layouts and other data) are held exclusively by FWG or its contractual partners.
Any reproduction, distribution, transmission, modification or other use of the content for commercial purposes is prohibited without the prior written consent of FWG.
 
13. Governing Law and Jurisdiction
All legal transactions shall be governed by Swiss law, to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods (Vienna Sales Convention, SR 0.221.211). In commercial legal transactions, Aarau is agreed as the place of jurisdiction.
